1. Introduction
These Terms and Conditions (“Agreement”) govern your access to and use of broadband internet and related services provided by SkySpurt Limited (“SkySpurt”, “we”, “us”, or “our”) to all customers (“Customer”, “you”, or “your”). By subscribing to our Services, installing, or using our equipment, you agree to be bound by this Agreement. SkySpurt reserves the right to amend these Terms and Conditions at any time without prior notice, and such amended Terms shall be effective upon posting on our website or communication to the Customer.
2. Definitions
In this Agreement, unless the context otherwise requires:
- “Agreement” means these Terms and Conditions as read and accepted by the Customer.
- “Services” means the provision of internet access, broadband connectivity, hardware, network access, and any additional service plans offered by SkySpurt.
- “Equipment” means the wireless routers, modems, antennas, or any other hardware devices supplied by SkySpurt to enable access to the Services.
- “Billing Cycle” means the recurring period at which subscription charges are billed (e.g., monthly).
- “Network” means the infrastructure owned or operated by SkySpurt or its partners that enables connectivity, data transmission, and internet access.
3. Service Scope
3.1 Provision of Services
SkySpurt shall provide internet connectivity to the Customer for the period the Customer has subscribed to use the Services, subject to payment of all applicable fees.
3.2 Modification of Services
SkySpurt reserves the right to withdraw, amend, modify, or discontinue any Service, Service package, pricing plan, or promotional offering at any time without prior notice.
3.3 Network Performance
SkySpurt is committed to planning and operating its network to deliver uninterrupted internet service; however, because the provision of the Services relies in part on third-party infrastructure and operations, uninterrupted, error-free, or continuous access cannot be fully guaranteed, and performance may be affected by limitations arising from such third-party dependencies or other external factors beyond SkySpurt’s control.
3.4 No Liability for Third-Party Transactions
SkySpurt will not be liable for any loss, cost, or damage that arises from transactions conducted by the Customer over the internet.
3.5 Content Access
SkySpurt is not responsible for the content accessed through the internet and may restrict access to content that violates Nigerian law or regulatory directives.
4. Equipment and Installation
4.1 Ownership
All Equipment remains the property of SkySpurt. The Customer is granted a non-exclusive right to use such Equipment during the Service period.
4.2 Installation
The Customer shall ensure that installation of any required hardware is done by a competent person. SkySpurt or its agents may support installation but cannot be held liable for damage caused during installation by third parties.
4.3 Loss or Damage
The Customer is responsible for the safety, proper use, and security of the Equipment. Any loss, theft, or damage to Equipment while in the Customer’s possession may incur replacement or repair charges at prevailing market rates.
4.4 Relocation
Relocation of fixed internet access devices requires SkySpurt’s approval and may attract additional fees.
5. Customer Obligations
5.1 Proper Use
The Customer shall use the Services in a lawful manner and not engage in activities that disrupt network performance or infringe on the rights of other users.
5.2 Security
The Customer agrees to implement reasonable security and network protection measures, including password protection and antivirus software, to prevent unauthorized access.
5.3 Compliance
The Customer must comply with all Nigerian laws and regulations when using the Services and shall not use the network to transmit illegal, offensive, or harmful content.
6. Billing, Payments & Suspension
6.1 Fees and Charges
The Customer shall pay all subscription fees prior to connection or service renewal, under the billing terms specified by SkySpurt.
6.2 Suspension
SkySpurt may suspend Services immediately, without notice, where payments are not received, or there is evidence of fraud, breach of this Agreement, or legal requirement.
6.3 No Hold Requests
Once payment has been made, all subscriptions are deemed active and confirmed, and no requests for account suspension, temporary hold, pause, deferment, or refund shall be entertained, whether due to non-usage, relocation, travel, service dissatisfaction, or any other reason, except where expressly permitted under SkySpurt’s stated Refund Policy or required by applicable law. All payments made to SkySpurt are non-transferable and non-refundable, and unused service periods shall not be credited, carried forward, or converted to cash.
7. Privacy & Data Protection
SkySpurt is committed to protecting the privacy, confidentiality, and security of its customers’ personal data and shall collect, use, process, store, and disclose personal information strictly in accordance with its Privacy Policy and the provisions of the Nigeria Data Protection Act (NDPA) 2023, including all applicable regulations and guidelines issued thereunder.
SkySpurt may collect personal information necessary for the provision and administration of its Services, including but not limited to customer names, contact details, service addresses, identification information, usage data, and correspondence records. Such information shall be processed solely for legitimate purposes, including service delivery, billing, customer support, regulatory compliance, fraud prevention, and improvement of service quality.
SkySpurt does not collect, process, or store customers’ bank account details, debit card details, credit card details, or other sensitive payment instrument information. All payments made for SkySpurt Services are processed through secure third-party payment platforms, which are independently responsible for handling and safeguarding customers’ financial information in accordance with applicable data protection and payment security standards. SkySpurt shall not be liable for any breach arising from the systems of such third-party payment providers, except to the extent required by law.
Personal data may be shared with trusted third parties, service providers, or partners solely to the extent necessary for the performance of SkySpurt’s Services, subject to appropriate confidentiality and data protection obligations. SkySpurt may also disclose personal data where required by law, court order, regulatory directive, or lawful request from government, regulatory, or law enforcement authorities.
Customers have rights under the NDPA 2023, including the right to access, correct, update, restrict, or request deletion of their personal data, subject to lawful limitations. SkySpurt shall implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure.

8. Force Majeure
SkySpurt shall not be liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, power failures, or regulatory interventions.
9. Amendment of Terms
SkySpurt may modify these Terms and Conditions at any time for operational, legal, or regulatory purposes. Notice of changes will be posted on the SkySpurt website and will apply upon posting or at an effective date specified.
10. Disputes and Governing Law
Any dispute arising from this Agreement shall be resolved under the laws of the Federal Republic of Nigeria and submitted to the competent courts of Lagos State (or another agreed jurisdiction).
